RELEASE AND WAIVER OF LIABILITY AGREEMENT
On behalf of myself and the minors listed below, I acknowledge that I have voluntarily agreed to participate in activities at and utilize the JoyLand Club’s facilities.
I represent that I am the parent, guardian, or otherwise legally authorized caretaker of the following minor(s) listed minors.
I MAKE THIS AGREEMENT ON BEHALF OF MYSELF AND THE LISTED MINORS (“PARTICIPANTS”). I AM AWARE THAT UTILIZING JOYLAND CLUB FACILITIES AND PARTICIPATING IN RELATED ACTIVITIES ARE HAZARDOUS AND MAY CAUSE SERIOUS INJURY OR EVEN DEATH. I AM VOLUNTARILY PARTICIPATING AND AUTHORIZING MINOR CHILDREN IN MY CARE TO PARTICIPATE IN ACTIVITIES WITH KNOWLEDGE OF THE DANGER INVOLVED AND AGREE TO ASSUME ANY AND ALL RISKS OF BODILY INJURY OF ANY NATURE, DEATH, OR PROPERTY DAMAGE, WHETHER THOSE RISKS ARE KNOWN OR UNKNOWN.
As consideration for being permitted by JoyLand group LLC to participate in activities and use the premises and facilities of the Club, Participants forever release JoyLand group LLC, (Joyland Club) any affiliated organization, their respective owners, directors, officers, employees, volunteers, agents, contractors, and representatives (collectively “Releasees”) from any actions, claims, or demands that the Participants or their assignees, heirs, distributees, guardians, next of kin, spouse, and legal representatives now have, or may have in the future, known or unknown, for injury, death, or property damage, related to (i) participation in these activities, (ii) the negligence or other acts, whether or not directly connected to these activities, and however caused, by any Releasee, or (iii) the condition of the premises where these activities occur, whether or not then participating in the activities.
Participant understands and agrees to adhere to the Safety Rules and Play Guidelines (“Rules and Guidelines”) as outlined at joylandclub.com. Participant acknowledges that I have read and am familiar with the Rules and Guidelines prior to entering the play space and using the facility.
I understand that the Releasees are not responsible for the supervision, care, and/or monitoring of Participants, and it is my responsibility to supervise, care, and/or monitor listed minor Participants and any other I bring onto the premises.
I understand that Releasees do not guarantee the safety of the Participants utilizing the facilities, engaged in the activities, or otherwise present on the premises. I have made my own investigation of these risks, understood these risks, and assumed them knowingly and willingly on behalf of myself and listed Minors.
Indemnification and Hold Harmless. Participant agrees to indemnify and hold harmless the Releasees with respect to any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorney’s fees and costs, incurred due to claims brought by any party as a result of or arising out of Participants’ utilization of the facilities, participation in activities, or presence on the premises.
Security Cameras. Participants understand that security cameras installed around and within the Joyland Club facility are for the safety of all participants.
Photo Release. Participant grants the Joyland Club permission to use any photographs, video, or sound bites obtained of any Participant, including minor Participants while on the Joyland Clud premises for any legal use including but not limited to: publicity, advertisement and web content. I understand that no royalty or other compensation shall be payable to me or any other Participant because of such use.
Parent or Legal Guardian Certification and Consent—I certify that I am the parent or legal guardian of the minor Participant’s children whose name(s) appear below and have the authority to waive rights on behalf of the minor Participant(s). I have read and understood all of the provisions of this document and the risks of the activities. I acknowledge that I have read and understood the terms of this document and am voluntarily signing it. This Agreement has no expiration date.
I HAVE CAREFULLY READ THIS AGREEMENT AND FULLY UNDERSTAND ITS CONTENTS. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A LEGALLY ENFORCEABLE CONTRACT BETWEEN MYSELF, ANY OTHER PARTICIPANTS, AND RELEASEES, AND I SIGN IT OF MY OWN FREE WILL.
